Library of Congress breaks the iPhone tether

Want to override your iPhone’s system controls? Now there’s an app for that. Thanks to Monday’s Library of Congress ruling allowing the “jailbreaking” of iPhones, users can now legally override Apple’s operating system to allow third party applications. In weighing certain exceptions to the Digital Millennium Copyright Act, the LOC gave four basic “fair use” arguments for siding with the Electronic Frontier Foundation and against Apple:

1. Jailbreakers are modifying a device they own for private, noncommercial purposes
2. Operating systems customarily enable third party programs and doing so on the iPhone doesn’t infringe on exclusive Apple copyrights
3. The amount of recoding performed during a jailbreak is negligible– 50 bytes of code out of a total of over 8 million
4. Jailbreaking doesn’t devalue Apple’s firmware or iPhones in the marketplace and might even help it by allowing users a wider variety of app choices

The Library of Congress’ explanations confirm what is apparent to most– that Apple’s real reason for exerting absolute control over it’s iPhones and App Store is to strengthen it’s bottom line without regard for what consumers want. Despite a respectful tone, the LOC’s message to Apple is clear: there is no legal basis for this kind of exclusivity, and we won’t do your dirty work by agreeing to this logic. Apple’s Gripgate saga deepens

Few things are as unnerving as an organization publicly improvising a PR strategy in the face of unexpected calamity. With BP, it took weeks to strike a sincere apologetic tone and admit wrongdoing. During the 2008 election when the Bristol Palin pregnancy story broke, it took the McCain camp a few days to refine the story of how the vetting process unfolded.

By most standards the Apple Gripgate saga that has Silicon Valley buzzing since the iPhone 4 launch is a mild calamity, but it looks to be getting worse. Consumer Reports unleashed an in-depth scientific test this week indicating the iPhone 4’s antenna is flawed in a way no other previous iPhone antenna has been, and is prone to dropping calls when the phone is gripped in the lower left corner. The reviewer would not recommend the phone and openly calls for Apple to provide consumers with free phone coverings (which does fix the problem) or some alternate solution.

Mobile gaming revenues exploding

Games figured heavily in the (official) introduction of the iPhone 4G and according to industry research, it’s easy to see why. A recent Nielsen study found games are the most frequently used apps, ahead of more utilitarian categories such as social networking, news and navigation. Games are also at the top of the entertainment app heap, with more usage than anything having to do with either music or movies. Current projections see global mobile gaming revenues surpassing $5.6 billion in 2010.

Here are a few of the new iPhone’s gaming-relevant updates. A new chipset and the promise of faster processing could improve the speed and graphic quality of games. Promises of better networking speeds could eventually allow better multiplayer or even eventually streaming experiences. A better camera on the back and a new camera on the front might allow iPhone developer to take creative cues from existing game platforms and eventually yield some interesting changes in the way players can control the experience. The new iPhone also has a built-in gyroscope, promising more refined game control. The near-term implications are obvious: better mobile games and competition against the mobile games platforms from Nintendo or Sony. The potential long-term ramifications are far more compelling. How the iPad is reshaping the Web

iPad continues to create ripples through the mobile, eReader, and online applications worlds. Here are five ways the device is transforming the Web as we know it:

1) Where has all my flash gone?  Or Hello, HTML 5
This is playing out in the press with a great flourish as everyone scrambles to understand apple’s strategy and relationship with Adobe.   85% of the top websites use flash (according to Adobe Labs) so Flash isn’t going to go away but HTML 5 will be a new way to navigate the web and consume applications,  without relying on Java or other plugins.  The very nature of how pages are built and how you navigate the web will be an application metaphor.  And playing off the current popularity of location based services, with HTML5, the browser on any device can detect the user’s geographical location if approved by that user.  This makes it possible for web pages to explore location aware experiences.   And video consumption will also really benefit because you won’t be relying on proprietary plug-ins that are CPU intensive.  And as of this week, Revision 3, a popular broadband TV site, announced it now supports video playback on the Apple iPad, thanks to its foray into HTML5.  You’ll see other major video consumption sites follow suite as the game changes again for video on and offline.  (HTML 5 will also be a player in the set top box world) Continue reading “How the iPad is reshaping the Web”

Why Apple shut down LaLa

In another disappointment for U.S. music fans, Apple announced last week that it would shutter online music service LaLa on May 31st— only months after purchasing the company for over $80 million in December 2009. Started in 2006, the company allows users to create and share music playlists, access music collections from any computer, purchase MP3s, or buy the right to stream songs indefinitely for ten cents. The site gained notable exposure in the music community when taste making blog Pitchfork Media began using LaLa widgets and playlists to accompany it’s music reviews. The announcement leaves room for speculation as to Apple’s motivation and its next move in the music space.

Many predict Apple will use LaLa’s “cloud” technology to launch a music subscription service within the iTunes platform– LaLa, unlike iTunes, stores music on servers which users can access in addition to direct dowloading. In a world of lost iPods and constantly updating technology, that convenience could add substantial value to an already established brand. The Wall Street Journal also reports that Apple will likely start an iTunes.com site this year empowering users to play music without the currently required iTunes software. This would open Apple’s music business to a larger audience and position the company to tap into a growing mobile market. Forrester Research projects that today’s 2.1 million music service subscribes will mushroom to over 5 million by 2014, due in part to an expansion of music streaming on smart phones. App vs. WebApp: A philosophical difference

App vs WebApp (Chrome/iTunes)Last week two items of note occurred. Apple released the iPad, and Google announced they would be building Flash into Chrome and Chrome OS. These two announcements highlight a growing difference between Apple and Google’s strategies for the future of computing. Both agree it’s mobile, but they have strong differing opinions on the issue of App vs WebApp.

Apple has had an interesting evolution. When the iPhone OS was first released, Apple staunchly positioned it as web apps only, with no native applications allowed. Eventually, after a small community of hackers got apps to work on the phones and even created a single app to find, download, and update their apps, Apple caved in. We then got a SDK for native applications, and finally arrived in the age of “There’s an App for that.” The iPad as a device is the epitome of this mentality. The iPad is about taking experiences that live elsewhere, whether Netflix or the New York Times, and creating an even better, completely customized experience for a single device. iPad, IAD, and Me

iPad, IAD, and Me (EA/Apple) The iPad is here — and with it, apps. And games. And ads. The iPad arrived on April 3. Rumor is, on April 7 Apple will reveal what it’s done with Quattro and showcase the future of the ad platform for its mobile operating system. This announcement could, in a very real way, mobilize (pun intended) casual gaming ad opportunities.

Did you know there are more iPhones and iPod Touches out there than Wiis? Or that Apple is eating away at the handheld gaming market revenues, despite the games on its platform being a fraction of the price that others charge?

A solid advertising platform from Apple will represent a unified offering for iPhone OS games. Based on where Apple’s interest lies for its iPhone platform, the ad platform should be very publisher-friendly, and potentially able to generate revenue for publishers better than current ad networks. iPad creates more questions than answers

With the iPad, it's not why, but "why not?" There’s a lot of debate as to whether or not the iPad is a game changer. After all, isn’t changing the game what Apple does best? The iPod changed the media consumption game. iTunes changed the media purchase game. The iPhone changed the mobile game. Macs are an ongoing effort to change the PC game. Apple invades thriving markets and smoothes out the edges, giving consumers a simplified way of approaching familiar problems.

What game is the iPad playing? It’s a tablet PC in form factor alone. Is it an e-reader? Is it a web browsing tool? Is it a laptop replacement? Is it a desktop supplement? Is it for productivity? Entertainment? Is it for Millenials? Boomers? Toddlers? Is it for everybody? Is it supposed to do everything? What makes the iPad a truly unique Apple product may be the fact that it subverts Apple’s successful change-the-game model – this time, Apple might actually be inventing games as opposed to changing them.

Rather than asking if the iPad changes the game, maybe we should ask why the iPad exists. Is it possible that Apple might have developed a product without knowing exactly what problem they were solving? Continue reading “iPad creates more questions than answers”

Motion-based marketing moves forward

Moving forward with motion-based marketing (iStock)Humanity has come to an intriguing crossroads. Our technology is evolving faster than ever, and yet the human experience hasn’t changed much since the golden age of Rome. We stand on the verge of a collision between these two worlds as our technology becomes increasingly integrated with the innate methods humans use to interact with the world. It’s a trend of “engaging the primal.”

Interface technology is an interesting field right now. It takes a long time to move forward, but when it does, the world moves along with it. For a time, we interacted with technology and computers through punch cards that indicated what we wanted done. Eventually, we re-purposed the legacy interface of a typewriter to arrive at the keyboard, expanding the accessibility of computers to most households. Then in 1963, the mouse was invented and with it computers eventually became centered around graphical interactions, no longer requiring arcane command line input.  Today the hot new interface technology revolves around kinetics. Multi-touch screens, image and gesture recognition, internal gyroscopes — as these technologies advance, devices like the Wii and the iPhone are quickly moving from outliers to standards.
